Welcome to Suma Nirvana. These Terms and Conditions govern your use of sumanirvana.com and any purchase made through our website. By accessing the website, creating an account, or placing an order, you confirm that you have read, understood, and agreed to these Terms and Conditions, our Privacy Policy, and our Return Policy.

1. ELIGIBILITY

You must be at least the age of majority in your province, state, or country of residence to make a purchase, or have permission and supervision from a parent or legal guardian.

You agree to provide complete, current, and accurate information when placing an order.

1. PRODUCTS AND HANDMADE VARIATIONS

We make reasonable efforts to describe and photograph our products accurately. However, colours may appear differently depending on lighting, photography, and screen settings.

Many Suma Nirvana products are handmade or contain natural or handmade elements. Small differences in colour, texture, stitching, shape, size, placement, or finish are part of the unique nature of these items and are not considered defects.

Measurements are approximate unless specifically stated otherwise. Customers are responsible for reviewing product descriptions, dimensions, materials, care instructions, and available options before purchasing.

1. PRICES, CURRENCY, AND TAXES

Unless otherwise stated, prices displayed on our website are in Canadian dollars (CAD). Applicable taxes and shipping charges will be calculated or displayed at checkout before the order is submitted.

For international orders, customers are responsible for any customs duties, import taxes, brokerage fees, or other charges imposed by the destination country. These charges are not included in our product or shipping prices unless expressly stated.

We reserve the right to change prices and promotions at any time. Changes will not affect orders already accepted and paid for.

1. ORDERS AND PAYMENT

Submitting an order does not guarantee acceptance. An order is accepted when payment has been successfully processed and an order confirmation is issued.

We may cancel or refuse an order because of suspected fraud, incorrect pricing, payment failure, inventory errors, shipping restrictions, or other reasonable business or security concerns. If we cancel a paid order, we will refund the amount collected for the cancelled items.

Customers are responsible for reviewing all order information before completing payment, including products, quantities, colours, sizes, personalization details, shipping address, and contact information.

1. ORDER CHANGES AND CANCELLATIONS

Because orders may be prepared soon after purchase, changes or cancellations are not guaranteed. Personalized or custom orders cannot be changed or cancelled once production has started.

To request a change, contact support@sumanirvana.com as soon as possible. We will make reasonable efforts to assist, but we cannot guarantee that a change can be made after an order has been submitted.

1. SHIPPING AND DELIVERY

Shipping costs, available delivery methods, and estimated delivery times are displayed at checkout or described in our shipping information.

Delivery dates are estimates unless expressly stated otherwise. Delays may occur because of weather, customs, carrier disruptions, holidays, incorrect addresses, or circumstances outside our reasonable control.

Customers must provide a complete and accurate shipping address. Additional costs resulting from an incorrect or incomplete address, refused delivery, or unclaimed package may be charged to the customer where permitted by law.

Risk relating to loss or damage during shipping will be handled according to applicable law and our Return Policy. If an order arrives damaged, the customer must contact us within 48 hours and provide the requested photographs and information so that we can investigate and submit a claim to the shipping carrier.

1. RETURNS, EXCHANGES, AND REFUNDS

All sales are final. We do not accept returns, exchanges, or refunds for change of mind, personal preference, incorrect size selection, minor handmade variations, or accidental purchases.

Claims concerning damaged, incorrect, defective, or missing items will be reviewed according to our Return Policy and applicable consumer-protection law. Unauthorized returns will not be accepted.

Nothing in these Terms limits any rights or remedies that cannot legally be excluded under applicable law.

1. PROMOTIONS AND FREE GIFTS

Promotions, discount codes, free-shipping offers, and complimentary gifts may be subject to additional conditions, minimum purchase requirements, availability, and stated expiration dates.

Unless expressly stated otherwise, promotional offers cannot be combined. Complimentary gifts may vary and have no cash value. We reserve the right to correct misuse, duplication, or technical errors involving promotional offers.

1. PRODUCT USE AND CARE

Customers are responsible for following any product care, washing, handling, or safety instructions provided with the product or in its description.

Decorative products, spiritual items, stories, and related content are offered for personal enjoyment and inspiration. They are not intended to diagnose, treat, cure, or prevent any medical or psychological condition and are not substitutes for professional medical, psychological, legal, or financial advice.

Products that are not specifically identified as toys should not be treated as toys and should be kept away from small children and pets where loose parts, cords, decorations, or other hazards may be present.

1. WEBSITE CONTENT AND INTELLECTUAL PROPERTY

The website and its original content—including text, photographs, graphics, branding, product designs, illustrations, logos, and other materials—belong to Suma Nirvana or are used with permission.

You may not copy, reproduce, modify, sell, distribute, publish, or commercially use our content without prior written permission, except where permitted by law.

1. ACCEPTABLE USE

You must not use the website to:

• Violate any law or the rights of another person • Submit false, fraudulent, abusive, or misleading information • Attempt unauthorized access to the website or customer accounts • Introduce viruses, malicious code, or harmful technology • Interfere with the website’s security or operation • Copy or commercially exploit website content without permission

We may restrict access or cancel an account when reasonably necessary to protect our customers, business, website, or legal rights.

1. THIRD-PARTY SERVICES AND LINKS

Our website is hosted through Wix and may use third-party payment, shipping, analytics, communication, or other service providers. Your use of certain third-party services may also be governed by their own terms and policies.

We are not responsible for the content, availability, security, or practices of independent third-party websites linked from our website.

We make reasonable efforts to keep the website accurate, secure, and available, but we do not guarantee that it will always operate without interruption or error.

To the maximum extent permitted by law, Suma Nirvana will not be liable for indirect, incidental, special, or consequential losses arising from the use of the website or products.

Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by applicable law. Nothing in these Terms excludes liability or customer rights that cannot legally be excluded or limited.

These Terms and Conditions are governed by the laws of British Columbia and the applicable federal laws of Canada, without limiting any mandatory consumer rights that may apply based on the customer’s location.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
